<p>•	In New Jersey, a state divorce law requires that both of the parties in the divorce be a state resident for at least one year before filing. This is true of other state divorce laws as well. Exceptions include when adultery has been committed and in that case, only one individual has to be a New Jersey resident. After the period of a year is up, had it not been already, the petitioner can file official divorce papers. Usually, this is done within the county that they live in but if the responding spouse lives somewhere else it is done there.</p>
<p>•	New Jersey state divorce laws declare that the husband or the wife is allowed to file for divorce on the grounds of &#8220;no fault&#8221; which means that both parties are declaring that they were not individually to blame for the divorce. This state divorce law is a problem for some though: this method of divorce takes a long time as a couple must be living apart for 18 months before they can even begin to file for divorce.</p>
<p>•	New Jersey state divorce laws are different when it comes to filing a divorce with fault involved. There are eight ways to file a divorce based on fault within New Jersey. State divorce laws declare that grounds for divorce based on fault includes mental or physical cruelty, adultery, abandonment, drug addiction, being institutionalized for mental problems, deviant sexual conduct and prison incarceration. When it is decided that the petitioner will be filing for divorce based on fault, then the state divorce law that requires separation becomes null and void. The divorce can immediately be proceeded with.</p>
<p>•	Marital property is divided equally between the couple, according to New Jersey state law. The courts can decide what things to consider when diving up marital assets. By New Jersey state divorce law however, the court is required to consider the length of the marriage, the health or age of each party, the amount of income brought in by each individual, and the general living conditions during the marriage itself. State divorce laws also require the judge to examine how each person&#8217;s ability to work is based on health, education and experience.</p>

Unlike residency rules that control most regular divorces, military divorce law allows an individual to pick the state that the soldier is stationed in, the state that the spouse is a current resident of, the state where the couple was married, or the state that the soldier has their permanent residence address in.</p>
<p>•	To determine what the amount of child support that must be paid, military divorce law states that service member&#8217;s gross pay must be carefully calculated. The gross income has to include housing allowance, subsidy allowance, basic pay, and any other possible salary increases like hazardous duty pay, if it will be continuous for at least six months. However, the civilian spouse is still required to show any pay stubs or income statements. If the service person is retired or disabled than they have to include their Veteran&#8217;s Fair disability pay in their total income amount. Depending on the state, this amount will be considered separately.</p>
<p>•	Different military branches have different ways of handling divorces and separations. Military divorce laws vary from branch to branch. In the United States Navy, the guidelines are standard and across the board for spousal and child support. In the Army, the courts decide what the amount of support will be depending on military law circumstances. While an individual is stationed in a war zone, they cannot be required to proceed with a divorce. Under military divorce law, this the service member from missing important hearings.</p>

<p>•	Because part of a marriage contract involves an agreement to be with only each other forever, adultery divorce laws are very important. There are some states in America that believes in no fault divorces that follow a particular set of divorce laws. Within these states, divorce laws specify that one doesn&#8217;t need any proof of adultery to file for divorce. However, some states do not permit no fault divorces. In those states, divorce laws are different. A divorce law regarding adultery in a state that does not offer a no fault divorce requires proof of adultery. Statistically, states that have lenient divorce laws about no fault divorces have higher divorce rates than others.</p>
<p>•	In states that have a divorce law specifying proof of adultery is needed, there are several ways to obtain this proof and have a divorce granted. Since adultery is considered to be a very serious reason for a marriage to end, adultery divorce laws will often not grant many assets to the party that is responsible for the adultery. The courts do not tend to have much sympathy on the one who committed adultery and divorce laws reflect that. In some states, an individual is still required to be separated first under state divorce laws, even with proof of adultery.</p>
<p>•	Divorce laws regarding adultery are not new. Even in biblical times, adultery was considered to be serious and a valid reason for divorce. In fact in those time that was the only way to obtain a divorce. Man women have been put to death for accused adultery. In today&#8217;s time, the proof that is required under current divorce laws to file for divorce based on infidelity is based on hiring a private detective. In states that have fault divorce, like New York, even one spouse admitting adultery is not enough proof to for one to file for divorce based on infidelity. It is because of this that many individuals choose to wait out a separation period and file on other grounds.</p>
<p>Because of the rigidness of divorce laws related to adultery, people who file based on adultery usually have reasons for doing so, such as financial gain. Under divorce law in certain states, the faithful spouse is rewarded with many assets while the spouse who committed adultery is made to pay for their adulterous actions.</p>
